NOTICE IS HEREBY GIVEN that the Town of New Shoreham Historic District Commission will be in session at the Town Hall on Monday, September 17, 2012 at 7:00pm for its regular monthly meeting.  All persons interested will be heard for or against the granting of the following application:
1. Estate of David K. Harrison.  Plat 18, Lot 6-1. Public Hearing for an Application to establish this property as an Historic District Zone pursuant to New Shoreham General Ordinances Chapter 7 Historical Preservation Section 3(B).

Proposed Amendment to New Shoreham’s Revised Ordinances
Chapter 8 Licenses and Business Regulations, Article II. AMUSEMENTS

The Town Council will hold a public hearing to consider deleting Chapter 8, Article II AMUSEMENTS in its entirety and replacing it with the following:  Sec. 8-16. Definitions.When used in this Article, the following words and phrases shall have the following meaning:
Game Room: A public place, building or room where three (3) or more gaming devices, machines, or apparatuses, including but not limited to pinball machines, computer gaming devices, electronic gaming devices, and video game machines, are available for the use and entertainment of the public and where public use of the devices, machines, or apparatuses for a fee is the principal source of income.
Gaming device: A machine, apparatus, computer component or electronic equipment, connected to an electrical outlet by one cord, on which a mechanical, electronic, video, or other game or amusement is played for a fee, and that is available for the use and entertainment of the public.
Table game: A game played on a horizontal surface, including but not limited to a billiard table, a bagatelle table, a pool table, or a scippio table, that is available for the use and entertainment of the public.
Sec. 8-17  License required. No person, corporation, or business shall keep or allow to be kept a gaming device or a table game for public use without first obtaining a license for each such gaming device or table game from the town council, except any games licensed by the state.
Sec. 8-18  License conditions.
(a)    The term of each license shall be one year. Each license shall expire on the 30th day of June.
(b)    The fee for each license shall be $200.
(c)    No more than three licenses shall be issued for one establishment, business, or premises.
(d)    No license shall be transferrable to a different location, a different gaming device or table game, or a different licensee.  
Sec. 8-19  Application. The application for such license shall contain the following information:
(a)    Name, address, and telephone number of the applicant;
(b)    Place where the gaming device or table game will be located  and the type of business conducted at that location;
(c)    A description of each gaming device or table game, including the manufacturer and serial number.
Sec. 8-20  Inspections required.  No license shall be issued until the premises has been inspected by the zoning enforcement officer and determined to be in compliance with the zoning ordinance.
Sec. 8-21  License Restrictions.
(a)    No license shall be issued for a gaming device until the applicant has obtained a special use permit from the zoning board of review for the gaming device. The town council may approve a license application subject to the granting of a special use permit, and in such a case the license term will not commence until the special use permit is granted.  
(b)    No licensee under this Article shall permit a person under sixteen (16) years of age to use or operate a gaming device or table game unless the minor is accompanied by a parent or guardian.
(c)    No licensee under this Article shall permit a person under eighteen (18) years of age to use or operate a gaming device or table game at a location where alcoholic beverages are sold.
(d)    No license shall be issued for any game room or for any electronic game of chance or sweepstakes played on computer hardware.    
Sec. 8-22  Suspension or revocation of license.
(a)    If a licensee violates any terms or conditions of this Article or of the license, the town council may compel the licensee to show cause why the license should not be suspended or revoked.
(b)    The town clerk shall notify the licensee by certified mail of the date, time, and location of the show cause hearing. The hearing shall be advertised in a newspaper in general circulation in the town at least seven (7) days in advance.
(c)    The licensee shall be allowed to present any evidence or testimony on his or her behalf. If the town council determines that such a violation has occurred, it may take whatever action it deems appropriate, including but not limited to suspension or revocation of the license.  
Sec. 8-23  Violation and penalties. Every person who operates a gaming device or table game without a license issued in accordance with this Article may be punished by a fine of twenty dollars ($20) for each offense. Each day the gaming device or table game is operated without a license shall constitute a separate offense.

At the time of the hearing all persons for or against may be heard and the Town Council may act on this proposal and/or amendments hereto.

Proposed Amendment New Shoreham Zoning Ordinance
Game Rooms, Gaming Devices

The New Shoreham Town Council will hold a public hearing to consider adopting a new Section 516 “Gaming Devices” to New Shoreham’s Zoning Ordinance and amending Sections 111 “General Prohibitions,” Section 202 “Definitions,” Section 311 “Old Harbor Commercial Zone (OHC Zone),” Section 312 “New Harbor Commercial Zone (NHC Zone),” and Section 313 “Service Commercial Zone (SC Zone).”  The changes follow, with proposed new language in underlined italics and language to be removed is shown stricken out (like this).  Before acting on the proposal and/or amendments to it, the Town Council will hear all persons for or against.  The proposed ordinance may be altered or amended prior to the close of the public hearing without further advertising, as a result of further study or because of the views expressed at the public hearing. Any alteration or amendment must be presented for comment in the course of the hearing.

79.    Gaming device:  A machine, apparatus, computer component or item or items of electronic equipment, connected to an electrical outlet by one cord, which upon the insertion of a coin, slug, token, plate, disc, or card may be operated by the public generally for use as a mechanical, electronic, video, or other game or amusement, whether or not it registers a score and whether or not the operation involves skill.

A. Gaming devices are permitted as an accessory use to a restaurant or retail trade establishment provided that the following standards are satisfied:
1.    No more than three (3) gaming devices may be located in one establishment.
2.    No gaming device shall be visible from the exterior of the building in which it is located.
3.    A license issued by the Town Council is required for each gaming device.
