Notice of Public Hearing
Proposed Amendment to New Shoreham General Ordinances
Chapter 7 Historical Preservation
Section 3 “Designation of Historic Districts and Structures”
The New Shoreham Town Council will hold a Public Hearing at 7:00 p.m. Wednesday, November 16, 2011 at Town Hall, Old Town Road, to consider amending Section 3 “Designation of Historic Districts and Structures” of New Shoreham General Ordinances Chapter 7 Historical Preservation.  The proposal would amend the ordinance below by adding the words in bold italics.
Before acting, the New Shoreham Town Council will hold a public hearing November 16, 2011 when all persons for or against may be heard.  The proposed ordinance may be altered or amended prior to the close of the public hearing without further advertising, as a result of further study or because of the views expressed at the public hearing.  Any alterations or amendment must be presented for comment in the course of the hearing.  The Town Council may act on the proposal and/or amendments thereto at the close of the public hearing.  
Chapter 7 Historical Preservation
Section 3:      Designation of Historic Districts and Structures
A.    For the purposes of this Chapter, the Town Council shall have the authority to establish, change, lay out, and define districts which are deemed to be of historic or architectural value.
1.    For the purpose of this section, all properties contained within the boundaries marked “Historic District Zone” on the official zoning map of the Town of New Shoreham shall comprise a Historic District.
2.    The Historic District Zone may also include specific buildings or structures of historic or architectural value established under Section 3(B) below.
B.    Applications for Specific Buildings or Structures for the Historic District Zone:
1.    An Application for inclusion of a specific building or structure for inclusion in  the Historic District Zone may be submitted  to the Historic District Commission on an Historic District Commission Property  Application form.  Applications may be submitted by the Historic District Commission, a property owner of record, the Town Council or any other person or organization.  All Applications must include a letter of consent from all of the owners of the property.
2.    The Historic District Commission shall schedule a public hearing on all complete Applications.
3.    The Historic District Commission shall, within sixty (60) days after the public hearing, adopt, by resolution, findings and a recommendation, which includes the rationale for its decision, whether the specific building or structure meets the criteria set forth in Section 2A for inclusion in the Historic District Zone. The property must also be a contributing structure designated by the Historic House Survey dated March 2008.  The resolution shall be forwarded to the Town Council and the Planning Board for consideration of an amendment to the Historic District Zone.

Section 9-86 “Procedure for Moorings and Anchorages”
The New Shoreham Town Council will hold a Public Hearing at 7:00 p.m. Wednesday, November 16, 2011 at Town Hall, Old Town Road, to consider amending Section 9-86 “Procedure for Moorings and Anchorages” of New Shoreham General Ordinances Chapter 9 Marine Activities, Areas and Structures, Article 3 Harbor, Division 3 Harbormaster.  The proposal would amend the ordinance below by deleting the strikethrough language and adding the words in bold italics.

Chapter 9, Article 3, Division 3
Section 9-86. Procedure for Moorings and Anchorages
(b)(6) Moorings are not transferable except with the consent of the Town Council based on an advisory opinion from the Harbors Committee.  For example, transfers may be allowed on a one time basis to a spouse or child in the event of death of the mooring permit holder. (A) The holder of a private mooring permit shall be entitled to transfer the private mooring permit on one occasion only either during the permit holder’s lifetime or upon the permit holder’s death to any one of the following relatives of the permit holder: spouse (including common-law spouse), child (including a step-child), sibling (including a step-sibling), or parent (including a step-parent).
(B) In no event shall the recipient of a private mooring permit transferred pursuant to this paragraph (6) be entitled to transfer the private mooring permit to any other person either during the permit recipient’s lifetime or upon the permit recipient’s death.
(C) In order to effectuate the transfer of the mooring permit, the permit holder shall file a Notice of Transfer with the Harbors Department on a form provided by the Harbors Department. The Harbors Department shall not accept a Notice of Transfer and no transfer shall be effective if there are fees owed with respect to the permit to be transferred or if the permit to be transferred is under a Notice of Revocation.

Zoning Modification Request
Jose & Maria Teresa De Lasa.  Plat 18 Lot 14.  Zoning Modification request to construct an addition onto a Single Family Dwelling.  The proposed addition will be located forty three (43) feet from the easterly property line of Lot 14.  A fifty (50) foot setback is required in the RA Zoning District.  If no written objections are received by abutting property owners by November 5, 2011 the Zoning Modification Permit will be granted.

PUBLIC NOTICE
Notice to all concerned parties who own vessels that have been left on Andy’s Way, the beach at the Narragansett Inn, and the beach between the Boat Basin and Champlins Marina, you will have until November 15, 2011 to remove your vessel from the areas stated above or the Harbors Department will have them removed at the owner’s expense.
